Human Rights Legal Forums
Human Rights Tribunal of Ontario
(HRTO)
For human rights matters that occur within Ontario’s provincial jurisdiction, the Ontario Human Rights Code applies.
Individuals can bring an application before the HRTO.
The HRTO has no momentary limit on claims submitted to the HRTO.
The HRTO generally awards between $5,000 to $25,000 for injury to dignity and self-respect
The HRTO cannot award court costs.
You have one year from the realization of the last known incident to bring a claim before the HRTO. There are some rare incidents where this time limit can be waived.
Presently, the delays before the HRTO are extremely excessive where applications can take between five and ten years to be heard!
Currently the HRTO has a 97% summary dismissal rating, where the HRTO is dismissing claims without a hearing based on an alleged lack of jurisdiction.
Canadian Human Rights Tribunal
(CHRT)
Civil Court
Small Claims Court
For human rights matters that occur within Canada’s federal jurisdiction, the Canadian Human Rights Act applies.
Individuals can bring an application before the CHRT.
The CHRT has momentary limit on claims submitted to the CHRT for pain & suffering and wilful & reckless discrimination.
The CHRT generally awards up to $40,000 for injury to dignity and self-respect
There is no limit on actual losses such as lost wages etc.
The CHRT cannot award court costs.
You have one year from the realization of the last known incident to bring a claim before the CHRT. There are some rare incidents where this time limit can be waived.
Presently, there are excessive delays before the CHRT!
In Ontario, the Human Rights Code allows a person to being a claim in Small Claims Court or Superior Civil court.
You can not bring a claim for human rights in small claims court you must include another claim such as wrongful termination of employment.
Paralegals cannot appear in Superior court
The maximum claimed amount in Small Claims Court is to $50,000
The court can award legal costs, but if you lose you would also have to pay legal costs
You have two years to bring a claim from the incident or last in a series of incidents
Considerably faster than HRTO or CHRT as a trail is generally set within a year of filing claim
